| April Court 1822
In the name of God Amen. I John Anderson of the County of Caswell and State of North Carolina being old and infirm of body but in perfect mind and memory calling to mind the mortality of my body and knowing that it is appointed for all men to die do make and ordain this my last will and testament, principally of all I commit my soul to God who gave it, nothing doubting but I shall recieve the same by the mighty power of God at the general resurection, my body to the earth to be buried at a decent Christian burial at the descretion of my Executors hereafter to be nominated, touching Such Worldly Estate as has pleased God to bless me with in this life, I dispose of the same in the following manner---- I lend to beloved wife Catherine Anderson during her natural life the Plantation whereon I now live together with all that appertains thereto, all my livestock of every discription, farming utensils, household and kitchen furniture except such as hereafter may be especially divided provisions on hand at the time of my decease and my Negros Tim, Sarah, Frank, Grace, Norman, George, Raus and Sueinda. It is my will and desire that all the balance of my negros except that one which will be hereafter himself especially givin. It is my will and desire that they be sold by my Executors giving my children notice thereof when no person directly or indirectly shall become a purchaser, except my children and if at that time any of my negros shall be purchased by my daughters, Mary Mitchell, Jane Ector or Caty Ector such negros I give to them during their natural life and at their death to their children in the proceeds of the sale of said negroes after paying all my just depts. My eight children, Mary Mitchell, Jane Ector, Caty Ector, Sarah Anderson, Elizabeth Anderson, Quinten Anderson and James Anderson and William Anderson to share and share alike and to those of my children who at that time purchase my negroes more than their equal parts of the value thereof to enter into bond with security as my executors may think sufficient to secure the payment of such sum as they may purchase over their equal part as above named which bond shall be made payable at 6 months to my executors. I give my son William Anderson one feather bed and furniture. At the death of my wife I give to my son William Anderson the value of tho hundred fifty dollars out of the property. I have lent her during her life to my daughter Mary Mitchell one walnut chest, to my son James Anderson and my daughters Sarah and Elizabeth the tract of land whereon I now live to be divided in such a way that James shall have the half including the place whereon he now lives and Sarah and Elizabeth the other half including the part whereon I now live. The part given to James I give to him during his life and at his death to his children. I give to my daughters Sarah and Elizabeth at my death my negro boy Watson and all furniture that is in my house and known to belong to them. At the death of my wife I give to my daughters Sarah and Elizabeth my cupboard and the contents thereof, my walnut table and two cows and calves. It is my will and desire that all my property lent to my wife during her life, except my negroes and other property herein especially divised at her death to be sold to the highest bidder at public sale, my negroes to be sold where no person directly or indirectly shall become a purchaser except my children and those of my negroes which at that time may be purchased by my daughters Mary Mitchell, Jane Ector or Caty Ector to vest title in them during their lives and at their deaths to their children in proceeds of the sale of the said property, my eight children to share and share alike. If any of the children at the sale of the above property and negroes should buy more than their notable parts to enter into bond with such security as my executors may think proper or sufficient to secure the payment of such sums as they may purchase over and above the their notable parts payable to my executors. Lastly I nominate and appoint my sons Quinton Anderson and William Anderson my executors to this my last will and testament hereby revoking all other wills by me heretofore made and acknowledge this my last will and testament in witness whereof I have hereunto set my hand and seal this 23rd day of August A.D. 1821.
